Although there is no regulatory statute that prohibits “open” floor model sharps containers without a feature to prevent a stray hand or overflowing, a picky surveyor could issue a citation based on preference.

However, a proper risk assessment that proves such a container is secured from the public (i.e. children), could prove that your facility has considered the risks and taken appropriate action.
